Twilio Identity Verification - Twilio Lookup API - SIM Swap and Line Type Intelligence, Lookup Call Forwarding, Reassigned Number, Identity Match, Phone Number Verification, and Verify Silent Network Auth

These Twilio Identity Verification requirements (“Identity Verification Requirements”) will apply to Customer to the extent Customer uses the Identity Verification Services (as defined below). These Identity Verification Requirements supplement the terms of the agreement between Customer and Twilio covering Customer’s use of the Services (“Agreement”). Except as otherwise expressly set forth in these Identity Verification Requirements, the terms of the Agreement, including, without limitation, any disclaimers and liability limitations set forth therein, will apply to the use of the Identity Verification Services.

The Agreement and these Identity Verification Requirements will not apply to Customer if Customer (a) uses any Identity Verification Services that are not Twilio Lookup API - SIM Swap and Line Type Intelligence, Lookup Call Forwarding, and Verify Silent Network Auth ("Boku Services") and (b) has executed a separate written agreement directly with Boku Identity, Inc. or Boku Mobile Solutions Ireland Limited (collectively, "Boku") covering the use of the Boku Services.

1. Definitions

Affiliate” has the meaning set forth in the Agreement.

Identity Verification Data” means certain attributes returned to Customer by Twilio relating to Customer’s submission of any data or information relating to Customer’s consumers through the Identity Verification Services. For the avoidance of doubt, Identity Verification Data does not identify any natural person.

Identity Verification Services” means the mobile identification and authentication services provided by Twilio and certain data service providers which provide Customer with Identity Verification Data.

Identity Verification Services Order Form” means an ordering document or service addendum between Customer and Twilio or Customer and Boku, as applicable, which sets forth the fees for the Identity Verification Services and any other terms contained therein.

2. Permitted Uses.  Customer may use the Identity Verification Services solely to validate a consumer’s identity for the purpose of averting fraudulent transactions, performing identity verification, authenticating commercial transactions initiated by a consumer with Customer, or for such other purposes as may be expressly set forth in the applicable Identity Verification Services Order Form(s).

3. Restrictions.  Customer will not use the Identity Verification Services or Identity Verification Data (a) for marketing purposes or to sell products or services; (b) to create a consumer report or allow use by a consumer reporting agency for the purpose of creating a consumer report; or (c) for verifying worthiness or eligibility for credit, insurance, or employment.

4. Security.  If any terms relating to security of any data or any other services provided by Twilio in or under the Agreement do not expressly include the Identity Verification Services, the applicable terms in the Security Overview, the current version of which is available at https://www.twilio.com/legal/security-overview, will apply solely to the Identity Verification Services.

5. Use Case Approval.  If applicable, Customer must submit an application which sets forth a true, accurate, and complete description of Customer’s intended use case(s) for the Identity Verification Services, which complies with Section 2 (Permitted Uses) and Section 3 (Restrictions) of these Identity Verification Requirements. Customer’s use of the Identity Verification Services is subject to the applicable data service provider(s) review and approval of Customer's use case application. For the avoidance of doubt, Twilio has no control over a data service provider(s) approval of Customer’s use case application. Customer is not entitled to any refunds or credits if (a) a data service provider(s) rejects Customer’s use case application or (b) Customer’s use case application contains information that is untrue, inaccurate, or incomplete. Customer will not use the Identity Verification Services for any use cases that are not approved by the applicable data service provider(s). If Customer wants to modify its approved use case(s), Customer must submit a new application for such modified use case(s) for approval.
